Pair of Md. Home Builders Have Registration Revoked

Maryland Attorney General J. Joseph Curran, Jr. announced that his Consumer Protection Division revoked the registration of two home builders for reportedly failing to comply with Maryland’s Home Builder Registration Act.

The Division suspended the registration of Ark Construction Inc. and its principal, Kelly M. Krick, Sr. of North Beach, Maryland, and also imposed a civil penalty of $1,000.

The builder recently pleaded guilty in Calvert County for violating the Custom Home Protection Act and entered into an agreement with the State’s Attorney’s Office providing for payment of subcontractors and barring him from future building activity. The builder had reportedly accepted payments of $89,508 from a consumer in North Beach whose home was destroyed by Hurricane Isabel but failed to complete construction of the home or pay subcontractors.

The Division also revoked the registration of Hutton Brothers Building and Improving of Elkton, Maryland. The builder’s Home Improvement license was suspended for reported failure to pay claims paid by the Maryland Home Improvement Commission’s Guaranty Fund.

The Maryland Home Improvement Commission claims concerned home improvement jobs that consumers had paid for but that Hutton Brothers Building and Improving had reportedly failed to complete or perform in a workmanlike manner.
