Judge Ends Pennsylvania Bus Driver’s Workplace Threat Suit
A federal judge has dismissed a Pennsylvania lawsuit filed by a fired Erie Metropolitan Transit Authority bus driver who claims he was wrongly fired after he was wrongly arrested for threatening the shoot up his workplace 10 days after a gunman killed 32 people at Virginia Tech.
The Erie Times-News reports Tuesday that the judge barred Augustus Allen’s lawsuit because it was filed after the two-year statute of limitations.
Transit officials had previously argued the lawsuit was baseless, saying Allen was fired for leaving the scene of an accident, so the alleged threats he made afterward on April 26, 2007 couldn’t have prompted the firing.
Allen’s suit also targeted police and prosecutors who brought threat charges that were eventually dismissed.
Allen filed a union grievance over his firing, which was also previously rejected.
