Ohio AG Reminds Law Enforcement Agencies Interested to File Against Second Chance Body Armor by May 31
Ohio Attorney General Jim Petro is reminding law enforcement officers and other governmental entities across Ohio about an upcoming deadline to file claims against Second Chance Body Armor Inc. Second Chance filed for Chapter 11 bankruptcy protection in 2004 and sent notices to those that purchased Ultima, Ultimax, or other Zylon vests manufactured by Second Chance.
Prosecutors, sheriffs, police and other governmental agencies who believe they have a claim against Second Chance are required to file a proof of claim in the United States Bankruptcy Court for the Western District of Michigan on or before May 31, 2005, or they may lose their right to participate in any distribution to creditors. Faxed claims will not be accepted by the Bankruptcy Court.
Second Chance announced in 2003 its concerns with the flawed bullet resistant fiber Zylon, manufactured by Toyobo Corp. of Japan, and agreed to replace the products. That announcement led to numerous lawsuits from class action lawyers and state attorneys general and Second Chance filed for bankruptcy.
