Bismark Agency, Agents Ordered to Cease and Desist
North Dakota Insurance Commissioner Adam Hamm has issued a cease and desist order against Jay Fettig and Danny Weigand, both of Bismarck, along with The Medicare Agency, The Founders LLC, ADN Insurance Services, ADN Wealth Management Group and all affiliated persons. The order bars these entities and individuals from acting as or holding themselves out as an insurance agency.
In late 2009, Fettig and Weigand submitted a business entity license application to the Department, requesting to be licensed as “The Medicare Agency.” After the Department expressed concern about the potential for consumer confusion because of the name, Weigand submitted another business entity application requesting to be licensed as “The Founders, LLC,” doing business as ADN Insurance Services, LLC. Weigand was listed as a partner.
The Insurance Department has not licensed “The Medicare Agency,” “The Founders” or “ADN Insurance Services.” The Department has learned that these individuals have used some of the names in soliciting business without approval. Websites and email addresses were also found that indicate these individuals used unapproved entity names.
“The Insurance Department takes this type of violation very seriously,” Hamm said. “Acting as if an entity is authorized to do insurance business or using a misleading or unapproved name for a business could cause consumer harm and will not be tolerated.”
