CSX Fraud Lawsuit Against Doctor, Law Firm Dismissed in West Virginia
A West Virginia asbestos fraud case filed by CSX Transportation against a Bridgeport radiologist and a Pittsburgh law firm has been dismissed.
The trial was to begin this week, but U.S. District Judge Frederick Stamp dismissed claims of fraud and conspiracy.
CSX had sued 74-year-old Dr. Raymond Harron and attorneys Robert Pierce and Louis Raimond, claiming Kentucky railroad worker Earl Baylor was fraudulently diagnosed with asbestosis.
But Stamp ruled Jacksonville, Fla.-based CSX lacked the evidence to prove intentional fraud.
In 2007, the doctor agreed to stop practicing in Texas, where he was under investigation by that state’s Medical Board for thousands of questionable diagnoses of the lung disease silicosis.
Harron was licensed there more than 45 years ago.
