ATV Crash Lawsuit Names Miami Hotel, Fired Cop
A lawsuit filed against a popular South Beach hotel and a former police officer is seeking damages for a woman seriously injured in a drunken all-terrain vehicle crash.
The lawsuit filed Thursday on behalf of 29-year-old Kitzie Nicanor names the Clevelander Hotel and former Miami Beach officer Derick Kuilan. Kuilan was fired over the July 3 crash and is charged with four felonies. It’s not clear if he has a lawyer.
The Clevelander planned a response later Thursday.
The lawsuit contends the hotel knowingly served alcohol to Kuilan and another on-duty officer. Prosecutors say Kuilan slammed his police ATV into Nicanor and her friend on the beach in predawn hours while speeding with no headlights on.
Nicanor’s attorney says she suffered a brain injury and may need years of rehabilitation.
