Mississippi Circuit Judge Tosses Civil Suit Against City
An Alcorn County judge has thrown out a civil suit against Corinth, Miss., officials stemming from a fatal 2009 traffic accident involving a city vehicle.
A trial was held in May. The Daily Corinthian reports that a ruling was issued Tuesday by Circuit Judge Thomas Gardner III.
The accident occurred on Sept. 24, 2009. Misty Joy Lipe of Corinth was killed when the vehicle in which she was a passenger collided with the back of a stationary city brush truck at the top of a rise.
The family argued the city was negligent for failing to flag and delineate the roadway approach, to train and supervise the workers on the scene and to deploy proper safety equipment.
The city denied any negligence.
