Alabama Court Overturns Wrongful Death Judgment Against Contractor
The Alabama Supreme Court has reversed a judgment against a Mobile-based contractor accused of doing a subpar road paving project that was blamed in a fatal car accident.
AL.com reported that the state Supreme Court ruled the case involving Hosea O. Weaver and Sons should never have gone before a jury. A court awarded $7.5 million to the estates of three people who died in a 2007 crash on Alabama 84. Plaintiffs argued the contracting company was negligent in its repaving job.
Supreme Court justices wrote that it didn’t matter whether or not the company improperly resurfaced the road.
Justices said the state certified the road as satisfactory in June of 2002 and the road became the Alabama Department of Transportation’s responsibility after that.
