Couple Sues New Mexico School Board Over Foul Balls
A Magdalena, N.M., couple upset by errant foul balls coming from a field near their home is taking their complaint to court.
The El Defensor Chieftain reports Thomas and Eleanor Key are suing the Magdalena Municipal School Board over foul balls that land on their property.
In court documents, the couple says baseballs from the field, which is across the street from their house, hit their property almost regularly and Thomas Key has been hit several times.
They say they fear going outside whenever there’s a baseball game.
They say in their lawsuit nothing changed after they told Superintendent Michael Chambers about the danger to them.
An attorney for the school board said Monday an earlier attempt to settle the complaint with a mediator was unsuccessful.
