Lawsuit Dismissed Over Golf Balls Landing in Montana Yard
A Ravalli County, judge says a couple should not be surprised that golf balls are littering their yard next to the fairway of a Hamilton, Mont., golf course.
Robert and Katherine Brady had sued the Hamilton Golf Club and Ravalli County in 2011 alleging trespass, nuisance and breach of duty.
The Ravalli Republic reports they built a 6-foot-tall cedar fence and then topped it with a 14-foot-high net in an attempt to keep the balls out. But close to 1,300 golf balls land in their yard during the course of a season.
The golf course pre-dates the Bradys’ home.
District Judge James Haynes says in his ruling they knew or should have known the issues with the home’s footprint next to the golf course when they bought it.
