Bike Rider Sues Santa Fe After Railroad Accident
A man who says he was injured when his bicycle wheel got caught in a railroad crossing groove is suing the city of Santa Fe and the state of New Mexico.
The Santa Fe New Mexican reports that Gregory Waits says in a complaint filed in state District Court last week that he sustained injuries to his face, head and body in May 2011. The complaint says he got the injuries after he tried to cross a railroad intersection at an “oblique angle” on a designated bike path.
Waits says the city and state governments created a dangerous condition and failed to warn bicyclists of the known hazard.
But the state Department of Transportation erected warning signs in late 2010 after another accident.
The city of Santa Fe did not immediately respond to an email from the Associated Press.
