Physician Preparedness Essential in Winning Malpractice Cases
What a physician experiences when facing a malpractice claim and the importance of a doctor’s preparedness in winning a lawsuit is detailed in a video released by The Doctors Company, a physician-owned medical malpractice insurer.
The video, the second in a series that showcases actual claims, features Thomas A. Del Zotto, DPM, of Associates in Foot and Ankle Care in Folsom, California. Dr. Del Zotto discusses the claim that was made against him and how—with the support of his insurer, attorney and claims specialist—he ultimately prevailed.
In the video, Dr. Del Zotto’s attorney, Dominique A. Pollara, Esq., of Schuering, Zimmerman & Doyle in Sacramento, Calif., notes that Dr. Del Zotto’s excellent documentation and ability to explain his thought processes clearly, as well as the fact that he came across as kind, compassionate and caring made for a strong case.
The video also features Dr. Del Zotto’s claims specialist, Lisa Wychgram, who states that Dr. Del Zotto’s credibility and preparedness were keys to winning his case.
“In relentlessly defending our members, every aspect of the case is taken into consideration, including selecting the best representation and providing experts to assist physicians in mastering defense tactics and delivering sound testimony,” said Laura Curtin, vice president, claims compliance officer, The Doctors Company. “As a result, over 80 percent of our cases end in no indemnity payment to the plaintiff, as in the case of Dr. Del Zotto.”
