TV Anchor Appeals Dismissal of Medical Malpractice Suit in Baltimore
Lawyers for former CBS “Early Show” anchor Mark McEwen have appealed the dismissal of his medical malpractice lawsuit.
A federal judge in Baltimore threw out McEwen’s lawsuit earlier this year. The 55-year-old McEwen suffered a massive stroke in November 2005 that he says could have been avoided if he’d received treatment for stroke-like symptoms two days earlier.
McEwen claims a doctor at Baltimore-Washington Medical Center told him he had stomach flu and sent him home.
McEwen’s lawyers contend U.S. District Judge J. Frederick Motz wrongly excluded testimony from two expert witnesses who said proper treatment could have prevented the stroke.
The appeal was filed with the U.S. Circuit Court of Appeals for the Fourth Circuit in Richmond, Va.
