Family of Indianapolis Crash Victim Sues City

The family of a motorcyclist killed in a crash involving an Indianapolis police officer has filed a lawsuit against the city, claiming that investigators improperly failed to give the officer a breath test for alcohol at the scene.

The lawsuit filed by the family of Eric Wells seeks at least $700,000 damages. It claims “gross negligence” by Officer David Bisard in the August crash that killed Wells and injured two others who were stopped at an intersection.

Prosecutors dropped drunken driving charges against Bisard because a blood test wasn’t done properly, but Bisard still faces reckless homicide charges.

Wells family attorney Linda Pence says officers at the crash scene were required by state law to give Bisard a breath test.

A city attorney couldn’t immediately be reached for comment.
