Indiana Attorney General Seeks Dismissal of 1 Fair Collapse Lawsuit

Indiana’s attorney general wants a judge to dismiss one of the lawsuits filed over the Indiana State Fair’s deadly stage collapse.

Attorney General Greg Zoeller asked a Marion County judge Monday to throw out a suit filed by Indianapolis law firm Cohen & Malad, arguing that it didn’t follow the legal process in suing on behalf of Indianapolis resident Angela Fischer.

Fischer says she was traumatized by the accident that killed seven people. Her suit seeks class-action status.

Zoeller says Fischer’s lawyers notified his office with a tort claim Aug. 22 of their plans to sue the state, and then filed suit the same day.

He says Indiana law declares the state cannot be sued until it’s had 90 days to review and approve or deny a tort claim.
