W. Va. Man Jailed, Indicted on Insurance Fraud Charge

Reynoldsville, W. Va., resident Carl Lee Gallo was indicted last week on one felony count of attempting to secure workers compensation benefits in excess of $1,000, according to officials.

The 67 year old Gallo is currently incarcerated in a federal prison in Pennsylvania on a parole violation. He had previously served just over 12 years on a 30-year sentence stemming from a 1984, 100-count indictment that included racketeering, tax evasion and drug charges.

Gallo returned to prison on a parole violation in March 2006 after being stopped for speeding and was found to be driving without a license and insurance.

“The Offices of the Insurance Commissioner’s Fraud Division will continue to aggressively investigate and seek prosecution on any type of insurance fraud” Insurance Commissioner Jane L. Cline said.

Gallo was indicted Jan. 3, 2007, for allegedly misrepresenting a medical condition to a variety of Harrison County doctors from June 2001 through November 2006.

Gallo faces a one to 10 year prison sentence on the felony insurance fraud charge; however, if found guilty, the U.S. Parole Commission could sentence him to the remaining 16 years left on his original sentence.

Prosecution and indictment in this case has been a joint effort with the Harrison County Prosecutor’s office and the Offices of the Insurance Commissioner’s Fraud Division.
