Judge Rejects Triple Damages in West Virginia Resort Suit
A judge in West Virginia says The Greenbrier’s former president isn’t entitled to triple damages in a severance pay dispute.
Paul Ratchford’s attorney said he plans to appeal the June 25 ruling of Greenbrier County Circuit Court Judge Joseph P. Pomponio to the state Supreme Court.
The severance pay issue is part of a $50 million lawsuit that Ratchford filed against CSX Corp. in March. The lawsuit claims Ratchford was forced out of his job for trying to end “fringe benefits” enjoyed by CSX executives at the four-star resort.
Ratchford’s lawyer, Barry Bruce, argued that state law requires benefits to be paid to fired employees within 72 hours. Bruce said Ratchford received $700,000 in severance pay more than a month after his dismissal.
