Ex-West Virginia University Student’s Family Wins $700K for his Care

The family of a former West Virginia University student beaten into a coma-like state three years ago will get $700,000 toward his medical bills under a lawsuit settlement.

U.S. District Judge Irene Keeley approved the deal Thursday but sealed the documents.

The Dominion Post says Ken Diviney agreed to a long-term, structured settlement because of his son Ryan’s shortened life expectancy. It also covers legal fees.

Ryan Diviney was a sophomore when he was beaten by six men during an off-campus argument in 2010.

Four people who were present but not accused in the attack settled previously. The new deal is with the two convicted, Austin Vantrease and Jonathon May.

Diviney has been in a vegetative state since the attack and receives 24-hour care at home in Ashburn, Va.
