Proposal Would Erase Arizona’s Ban on Lawsuits Limits
One of the first pieces of legislation prefiled for the Arizona Legislature’s 2012 regular session is a proposed ballot measure to repeal current constitutional protections for the right to recover damages through lawsuits.
The referendum proposed by Republican Rep. Jack Harper of Surprise would repeal two constitutional provisions that prohibit limits on recoveries through lawsuits, including one involving deaths or injuries to people.
Harper’s proposal doesn’t include a proposed limit but he says he wants a cap on awards so that Arizona would be a friendlier place for physicians and businesses.
