Hitching Post Owners Seek to Dismiss Fire Lawsuit
The owners of a landmark Cheyenne, Wyo., hotel that was destroyed in a 2010 arson are asking a judge to dismiss a lawsuit filed by its insurance company.
It’s the latest in legal action related to the Hitching Post hotel.
In December, Delaware-based CJM Hospitality LLC sued insurer National Surety Corp. in federal court in New Jersey for not paying for nearly $14 million in damages from the fire. This month, National Surety filed a lawsuit in Wyoming arguing the fire was started by the hotel’s owners and that therefore, it owes CJM nothing.
CJM has filed legal papers saying National Surety’s lawsuit should be dismissed because its lawsuit in New Jersey covers the same subject.
National Surety’s lawyer tells the Casper Star-Tribune he’ll file a response in court.
