N.H. Contractor Finds New Home at House of Corrections Following Scam
New Hampshire Attorney General Kelly Ayotte announced that the New Hampshire Supreme Court affirmed the conviction of James Moran, Jr. d/b/a Exterior Solutions who had previously been convicted of the crime of Unfair or Deceptive Business Act or Practice.
Moran was convicted of taking deposits from consumers in exchange for home contracting services. Moran reportedly failed to complete the agreed upon work and failed to refund the deposits.
After Moran was convicted, the court sentenced him to one year at the House of Corrections, 2 years probation, and ordered him to pay restitution to the victims. A condition of his sentence also prohibits him from owning, operating or managing a construction or building trades company for a period of 10 years.
Moran appealed his conviction to the New Hampshire Supreme Court and pending appeal, Moran was free on bail. His sentence will now be imposed.
In affirming Moran’s conviction, the Supreme Court said “It would be harmful for commerce in New Hampshire to condone such unethical and unscrupulous activity. The legislature promulgated the CPA [Consumer Protection Act] to protect consumers from this type of activity.” The court held that a violation of the Consumer Protection Act is not limited to the methods specifically enumerated in the statute.
