New York Contractor Gets Jail Time For Certificate Fraud

A New York contractor will serve a year in prison after pleading guilty in a case of workers’ compensation fraud.

Daniel Brabant, 45, of Bellmore, N.Y., was sentenced in the fraud case on May 5, 2008 after pleading guilty to offering a false instrument for filing, a misdemeanor, in Suffolk County Court. Brabant was arrested in October 2006.

The arrest and conviction resulted from an investigation conducted by The New York State Insurance Fund (NYSIF) Division of Confidential Investigations. Investigators said Brabant forged a NYSIF workers’ comp. insurance certificate that he used to secure a building permit from the Village of Lindenhurst.

Authorities said Brabant, who operated Tri Rail Construction, unlawfully used the business name and insurance identification of another contractor to obtain a renovation job in Lindenhurst, N.Y. Brabant presented the Lindenhurst Village Building Department an altered NYSIF certificate to show that he had workers’ compensation insurance, but he had no such insurance policy with NYSIF.

Brabany also received a concurrent sentence in connection with an unrelated grand larceny plea.
